I've encountered this before - I think the key is to make sure you're refunding it off the tree you already "own".

Checking my logs, my elementalist sat in on a 3 minute raid yesterday - it entered at 18:07:26, flag cap at 18:10:31. It had a full host of pets. Several valid enemy targets during that entire time.
